Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and opensky24 ("opensky24", "we", "us") governing your access to and use of the opensky24 website, the iOS and Android mobile applications and any related services (the "Services"). By creating an account, posting a listing or otherwise using the Services you agree to these Terms. If you do not agree, do not use the Services.

You must be at least 16 years old and able to enter into a binding contract under the laws of your country. By using the Services you confirm that you meet these requirements.

• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You must provide accurate information and keep it up to date.
• One person may not maintain multiple accounts to circumvent limits, bans or fees.
• Notify us immediately at info@opensky24.com if you suspect unauthorised use of your account.

opensky24 is a classifieds platform. Users post listings, messages and other content ("User Content"). You retain ownership of your User Content but grant opensky24 a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, translate and distribute it for the purpose of operating and promoting the Services.

You are solely responsible for your listings, including their accuracy, legality and your ability to sell or offer the item or service. You represent that you have all rights necessary to grant the licence above.

• No illegal items, counterfeit goods, weapons, drugs, stolen property, live animals where prohibited, or anything restricted by applicable law.
• No adult content, hate speech, harassment, doxxing, spam, scams or phishing.
• No misleading prices, fake listings, duplicate posts or keyword stuffing.
• No scraping, automated access, reverse engineering or interference with the Services.
• No collection of other users' personal data outside the in-app messaging flow.

We may remove content, restrict features or suspend or terminate accounts that breach these rules, at our discretion and without prior notice where necessary.

opensky24 is not a party to transactions between users. We do not handle payments, delivery, or guarantees of quality. You are responsible for verifying the other party, inspecting goods, and complying with consumer-protection and tax laws that apply to you. Meet in safe public places and use common sense.

Basic use of the Services is free. We may offer optional paid features (e.g. promoted listings) — their price and terms will be shown before purchase. All fees are non-refundable except where required by law.

The Services, including software, design, logos and trademarks, are owned by opensky24 or its licensors and protected by intellectual-property laws. You may not copy, modify, distribute or create derivative works except as expressly allowed by these Terms.

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy of listings. We do not guarantee that the Services will be uninterrupted, error-free, or that defects will be corrected.

To the maximum extent permitted by law, opensky24 and its officers, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or business arising from your use of the Services. Our aggregate liability for any claim shall not exceed EUR 100 or the amount you paid us in the 12 months before the claim, whichever is greater.

You agree to indemnify and hold opensky24 harmless from any claim, damages or expenses (including reasonable legal fees) arising out of your User Content, your use of the Services, or your breach of these Terms.

You may stop using the Services and delete your account at any time. We may suspend or terminate your access at any time if you breach these Terms or if required for legal, security or operational reasons. Sections that by their nature should survive termination will do so (including IP, disclaimers, liability limits and dispute resolution).

These Terms are governed by the laws of Greece, without regard to conflict-of-law rules. Disputes shall be brought before the competent courts of Athens, Greece, unless mandatory consumer-protection law gives you the right to bring the case in your country of residence.

We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
